Top Mallorca Constructions is the construction division of the Top Mallorca group. The Top Mallorca Real Estate and Top Mallorca Property Care brands also belong to the Owner.

Purpose of the Website

The Website gives information about the construction, refurbishment, restoration, Project Management and property maintenance services that the Owner provides in Mallorca, and enables anyone interested to contact the Owner to discuss a project or request a quote.

The contents of the Website are provided for information purposes and do not constitute a binding offer. The scope, price, timescales and other terms of each project are set out in the quote and in the contract, if any, signed by the Owner and the client. No services are contracted through the Website.

Terms of use

Anyone who accesses the Website becomes a user (hereinafter, “the User”) and accepts this Legal Notice in the version published at the time of access. If the User does not agree with it, they must refrain from using the Website.

Access to the Website is open and free of charge, apart from the cost of the User’s own internet connection, and does not in itself establish any commercial relationship with the Owner.

The User undertakes to use the Website and its contents lawfully, in good faith and in accordance with the law and this Legal Notice. In particular, the User undertakes not to:

  • use it for unlawful purposes or for purposes detrimental to the rights or interests of the Owner or of third parties;
  • introduce viruses or any other code that may damage, overload or prevent the operation of the Website or of the systems of the Owner or of third parties;
  • attempt to gain unauthorised access to restricted areas of the Website or to its systems;
  • submit false information, third parties’ data without their authorisation, or unlawful content through the forms;
  • reproduce or exploit the contents of the Website beyond what this Legal Notice permits.

Versions of the Website in other languages, where available, are translations. In the event of any discrepancy, the Spanish version shall prevail.

Intellectual and industrial property

The contents of the Website – texts, photographs, videos, graphic design, source code, logos and trade marks – belong to the Owner or to third parties who have authorised their use, and are protected by intellectual and industrial property legislation.

The photographs and videos of projects show homes on which the Owner has worked. They belong to the Owner or to its clients, who have authorised their publication on the Website; that authorisation does not extend to third parties.

The reproduction, distribution, communication to the public, transformation or any other form of exploitation, in whole or in part, of the contents of the Website without the prior written authorisation of the Owner is prohibited, except where the law permits this without such authorisation. Access to the Website does not grant the User any rights over its contents.

Linking to the pages of the Website is permitted provided that the link does not reproduce their contents, does not display them within another website (framing) and does not suggest that the Owner endorses, or has any relationship with, whoever creates the link.

Anyone who considers that any content on the Website infringes their rights may report it to info@topmallorcaconstructions.com, stating the content concerned and the right they consider to have been infringed.

Liability

The Owner endeavours to ensure that the information on the Website is accurate and up to date, but does not guarantee that it is free from errors or omissions, and may change it at any time without prior notice.

The blog articles on regulations, permits, timescales, taxes or costs are for general information: they reflect the situation on the date stated in each article and are no substitute for a professional’s assessment of each individual case. Before making a decision about building work or a property, it is advisable to check the information with the relevant technical professional, public authority or adviser.

The Owner takes reasonable measures to ensure that the Website functions correctly and is free from viruses and other harmful elements, but cannot guarantee its continuous availability or the complete absence of such elements. To the extent permitted by law, the Owner is not liable for any damage arising from interruptions, technical faults or causes beyond its control, or for any damage resulting from use of the Website contrary to this Legal Notice.

Nothing in this Legal Notice limits the rights granted to the User under consumer protection legislation.

Top Mallorca group websites

The Website links to other Top Mallorca group websites: topmallorcadevelopments.com (group website), topmallorcarealestate.com (estate agency) and topmallorcapropertycare.com (property care and maintenance). Each has its own legal notice and its own privacy and cookie policies, which apply when browsing that site.

Third-party websites

The Website may include links to third-party websites – for example, to the official sources cited in the blog or to social media profiles – solely for information purposes. The Owner does not control those websites and is not liable for their content, services or policies, and a link does not imply any relationship with the persons responsible for them or any approval of what they publish.

In accordance with Article 17 LSSI-CE, if the Owner has actual knowledge that a linked website contains unlawful information or activities, it will act diligently to remove the link.

Data protection and cookies

The processing of the personal data that the User provides through the Website is explained in the Privacy Policy, and the use of cookies in the Cookie Policy.

Amendments

The Owner may amend this Legal Notice, as well as the contents, configuration and presentation of the Website, at any time. The version published at the time of access applies; the date of the last update is shown at the top of this page.

Governing law and jurisdiction

This Legal Notice is governed by Spanish law.

For any dispute relating to the Website, the Owner and the User submit to the courts of Palma, unless the applicable legislation provides otherwise. In particular, where the User is a consumer, jurisdiction lies with the courts determined in accordance with consumer protection legislation, which, as a general rule, are those of the place where the User is domiciled.

If any clause of this Legal Notice is declared null and void, the other clauses shall remain valid.
