Buying in Mallorca
Buying land in Mallorca to build on: what to check before you sign (2026)
Before buying land in Mallorca to build on, you need to confirm that the plot can take a house and how much floor area can be built on it. The answer lies in the town council’s planning certificate, the Land Registry and, on rural land, the minimum plot size and the date of subdivision.

At a glance
- The planning certificate (certificado de aprovechamiento urbanístico) states whether the plot can be built on: it is issued within a month and is valid for six months (Balearic Planning Act, Ley 12/2017 de urbanismo de las Illes Balears, art. 64.2).
- On rural land (suelo rústico) only one house is allowed per plot, and you need 14,000 m², or 50,000 m² on forest land and land of landscape interest (Island Territorial Plan, rule 20).
- A rural finca subdivided since 13 October 1999 cannot take a house, except for the first division from parents to children.
- If the seller is a private individual, you pay transfer tax (ITP) of 8% to 13% in bands; if a company sells a building plot, 21% VAT and 1.5% stamp duty (AJD), or 2% from €1 million (2026 rates).
- As a general rule, a new villa on rural land cannot be let to tourists (Mallorca Tourist Areas Plan, PIAT, 2020).
Two plots with the same views can be advertised at the same price and yet have nothing in common: one can take a house, the other none at all. You cannot see the difference from the lane. It lies in the planning rules, in the Land Registry and, in the countryside, in the date the finca was divided.
So before buying land in Mallorca to build on, it pays to gather a few documents and do the sums. This guide sets them out in order, under the rules in force in October 2026. It is written by Top Mallorca Constructions, builders in Mallorca with projects in the south-west of the island and in Palma.
What should you check before buying land in Mallorca to build on?
Before buying land in Mallorca to build on, you need to confirm that the plot can take a house and how many square metres you will be able to build on it. Check in this order, because each step can rule the plot out before you spend money on the next:
- Land classification.
- Planning certificate.
- Land Registry extract (nota simple) and Cadastre record (Catastro).
- On rural land, minimum plot size and date of subdivision (segregación).
- Risk areas and road protection zones.
- Access and utilities.
- Ground conditions.
- Taxes and the seller’s tax residence.
Gathering the paperwork is straightforward; the expertise lies in turning it into buildable square metres and construction costs. That feasibility review is part of Project Management for a build, and we can carry it out with a qualified professional before you buy. If you are still looking for land to buy in Mallorca, Top Mallorca Real Estate, the group’s estate agency, has fincas for sale, some with plans already drawn up.
What can you build on urban, development or rural land in Mallorca?
On urban land (suelo urbano) you can apply for a building permit (licencia de obra) if the plot is a building plot (solar); on development land (suelo urbanizable), not while the area is still awaiting development. On rural land, which English-language listings often call “rustic land”, a house is at best a conditional use (uso condicionado) under art. 19.2 of the Balearic Rural Land Act (Ley 6/1997 de suelo rústico), and Mallorca’s Island Territorial Plan (Plan Territorial Insular de Mallorca) prohibits it in the most protected areas (rule 19.3, 2023 text).
| Land classification | Can it take a house? | What to check |
|---|---|---|
| Urban land | Yes, if it is a building plot | Services at the plot frontage |
| Development land | Not until it is developed | Stage of its planning process |
| Most protected rural land: natural areas (ANEI, AANP), wooded ARIP and territorial protection areas (APT) | No | Ruled out |
| Other rural land | Only as a conditional use | Minimum plot size, subdivision and report from the Consell de Mallorca (Island Council) |
Under the Balearic Planning Act (Ley 12/2017 de urbanismo de las Illes Balears, LUIB, art. 25), a building plot is an urban plot that borders public space and has the basic services at its frontage; fronting onto a road is not enough. So if you buy development or rural land in Mallorca, you are buying a house you have yet to prove you can build.
What is the planning certificate in Mallorca, and how long does it take?
It is the document in which the town council (ayuntamiento) states the planning status of a property and whether it can be built on. In the Balearic Islands it is called the certificado de aprovechamiento urbanístico: it is issued within one month at most and is valid for six months from notification (LUIB, art. 64.2). In Calvià the procedure is still called the cédula urbanística.
In Palma you apply for it through the City Council’s online office, with the cadastral reference and a fee of €36.28, and it can be requested by “any person with legal capacity”. Request it yourself before you sign the deposit contract (arras): it reflects the rules in force on the day it is issued. And it is not a permit: whether your design complies is decided later, during the building permit process in Mallorca.
What should you check in a plot’s Land Registry extract and Cadastre record?
The Land Registry extract shows whose name the property is in and what charges it carries. It also states whether the property is coordinated with the Cadastre, which provides the outline of the plot and its reference value. Cross-check the two: the area you buy is the one that counts towards the minimum plot size.
The extract has “purely informative value” (art. 222.5 of the Mortgage Act, Ley Hipotecaria, which governs the Land Registry); formal proof requires a Land Registry certificate (certificación registral). Also ask for the latest receipt for the annual property tax (IBI), because the property remains liable for any unpaid amount even after it changes hands (art. 64.1 of the Local Government Finance Act, Ley reguladora de las Haciendas Locales).
The Cadastre reference value (valor de referencia) is the minimum taxable base for property transfer tax (impuesto de transmisiones patrimoniales, ITP), even if the price you pay is lower, and the Constitutional Court upheld the system in its judgment 13/2026 of 12 February. The 2027 value maps, published on 25 September 2026, will apply to deeds signed from 1 January 2027.
What conditions must a rural plot in Mallorca meet for you to build a house on it?
Three, all at the same time: a category of rural land that allows a house, the minimum area and a valid subdivision. If even one is not met, you cannot build, however large the finca. The permit also requires a prior, binding report from the Consell de Mallorca, which has three months to issue it (Ley 6/1997, art. 36).
How many square metres does a rural plot need?
The Consell de Mallorca sums it up like this: “To build a new house on rural land you need a minimum area of 14,000 m², and only one house per plot can be authorised.” On forest land and in rural areas of landscape interest the minimum rises to 50,000 m² (Island Territorial Plan, rule 20.3), and the municipality may require more. For reference, 14,000 m² is twelve times the 1,161 m² plot of the villa we extended and refurbished in Es Capdellà.
When was the finca subdivided?
The date matters as much as the square metres (Island Territorial Plan, rule 20.4):
- Before 16 July 1997: no restriction.
- From 16 July 1997 to 13 October 1999: only if the division did not create more than five registered properties (fincas registrales), not counting the parent property.
- Since 13 October 1999: no house, except for the first division from parents to children by gift or inheritance, one plot per child and only once.
The permit requires a Land Registry certificate setting out the plot’s complete history: obtain it before you buy.
How much can you build on a rural plot?
In Mallorca you can build a floor area of up to 3% of the plot, with plot coverage below 4% and at most two storeys, 8 metres in height and 1,500 m³ per building (Ley 6/1997, art. 28). The Island Territorial Plan lowers these figures to 2% and 3% respectively in protected areas, forest land, areas of agricultural interest and three landscape units (rule 22). So on 14,000 m² of general rural land outside those units you can build at most 420 m², and in an area of agricultural interest, 280 m².
If the average slope exceeds 10%, you have to site the house on the flattest part. And swimming pools are limited to one per finca, with a maximum water surface of 35 m² and a maximum volume of 60 m³ (LUIB, art. 68 bis).
Which risks and restrictions can stop you building on a plot in Mallorca?
Two restrictions can leave a plot that meets all of the above without a house: flood zones and the road protection strip. Under Ley 4/2025, in force since 24 July 2025, new houses are still prohibited in flood-risk areas, unless the plot lies only partly within one and the house stays outside it.
In areas at risk of erosion, landslides or fire, and in areas where aquifers are vulnerable, a house becomes a conditional use. In fire-risk areas, water tanks are required, along with vegetation management within a 30-metre radius of the house (Island Territorial Plan, rule 20.3).
The Balearic Roads Act (Ley 5/1990 de carreteras de la Comunidad Autónoma) prohibits building or extending within the protection zone (art. 33.3.g), which is measured from the edge of the roadbed (arista de explanación): 25 metres on roads with four or more lanes, 18 on two-lane roads in the primary and secondary networks and 8 on local and rural roads (art. 31). You can view the risk layers on the Island Territorial Plan map viewer, but it is the town council’s certificate that carries formal weight.
How do you check a plot’s access, water, electricity and drainage?
On urban land, services at the frontage are a condition for the plot to count as a building plot (LUIB, art. 25). On rural land there is usually no mains sewer, and water supply and wastewater treatment are dealt with on the finca itself, each with its own procedure.
If access crosses a neighbouring property, check that the right of way is recorded in the title deeds or in the Land Registry extract. A well needs an authorisation or concession from the water authority, and off-mains wastewater treatment is governed by the Balearic Hydrological Plan (Plan Hidrológico de las Illes Balears, Real Decreto 49/2023). For electricity, ask the distribution company for the connection point and a quote for the supply connection before you agree the price.
Do you need a geotechnical survey before buying land?
It is not compulsory before you buy: the Technical Building Code (Código Técnico de la Edificación) places it at the initial design stage (DB SE-C, section 3.1). But if the plot is on a slope or has had previous uses “such as kilns, market gardens or landfills”, a ground investigation before you agree the price will tell you how much the foundations could cost. The Balearic Government’s map viewer, IDEIB, provides the geological map free of charge.
Can a new villa on rural land in Mallorca be let to tourists?
As a general rule, no. On protected rural land it is prohibited to start marketing homes to tourists (art. 50.18 of the Balearic Tourism Act, Ley 8/2012 del turismo de las Illes Balears). On common rural land, the Mallorca Tourist Areas Plan (Plan de Intervención en Ámbitos Turísticos de Mallorca, PIAT, 2020) only allows it in homes that already existed when the plan was initially approved (art. 38.5.a), precisely so as not to encourage building new houses on rural land for that purpose.
Across the island, moreover, the acquisition of tourist bed places (plazas turísticas) for homes remains suspended, except for certain strictly regulated exchanges (Ley 3/2022, first additional provision). And the Tourism Act requires five years of residential use before a home can be marketed to tourists, unless a regulation sets a different period (art. 50.17). If your investment depends on that rental income, a rural plot will not sustain it.
What taxes do you pay when buying land in the Balearic Islands?
When buying land in Mallorca to build on, you pay property transfer tax (ITP) of 8% to 13%, in bands, if the seller is a private individual. If a company sells you a building plot, you pay 21% VAT (IVA) and stamp duty (actos jurídicos documentados, AJD) at 1.5%, or 2% from €1 million. The municipal capital gains tax (plusvalía municipal) is paid by the seller.
| Situation | What is paid | 2026 rate | Legislation |
|---|---|---|---|
| A private individual sells | ITP | 8% up to €400,000; 9% up to €600,000; 10% up to €1m; 12% up to €2m; 13% above that | Decreto Legislativo 1/2014, art. 10 |
| A company sells a building plot or buildable land | VAT and AJD | 21% VAT; AJD at 1.5%, or 2% from €1m | VAT Act (Ley del IVA), arts. 20 and 90; DLeg 1/2014, arts. 15 and 17 bis |
| A company sells rural land without a building permit | ITP, because it is exempt from VAT | ITP scale | VAT Act, art. 20.Uno.20.º |
| Urban land is sold | Municipal capital gains tax, paid by the seller | Palma: 18% from 2026 | Local Government Finance Act, arts. 104 and 106; Palma tax by-laws (ordenanzas fiscales), art. 8 |
| The seller is not resident in Spain | Withholding paid to the tax authorities by the buyer | 3% of the price | Non-Resident Income Tax Act (Ley del Impuesto sobre la Renta de no Residentes), art. 25.2 |
The ITP scale is applied band by band: if you buy land worth €1,500,000 from a private individual, you pay €150,000, an average of 10%; if it is a building plot sold by a company, €315,000 in VAT and €30,000 in AJD (our own calculations). For ITP and AJD, the taxable base is never lower than the Cadastre reference value. And if the seller of a building plot is a non-resident individual, the buyer pays the municipal capital gains tax in the seller’s place, as substitute taxpayer (Local Government Finance Act, art. 106.2).
What does a foreign buyer need to buy land in Mallorca?
You need an NIE (foreigner identification number), because the purchase cannot be registered without the identification numbers of everyone who signs (Mortgage Act, art. 254.2). And if you are not a citizen of the European Union, as is the case for British nationals since Brexit, and the finca lies outside urban areas, you also need prior military authorisation.
It is a common situation. Foreign buyers made 29.86% of home purchases in the Balearic Islands in 2025, and 39.05% of them were German (Land Registrars, 2025 yearbook). In the second quarter of 2026 the figure reached 32.27%, the highest share of any Spanish region (Land Registrars, Q2 2026).
Real Decreto 689/1978, the regulation on zones of interest for national defence, declares all the islands a zone of restricted access to property ownership by foreigners, except for urban areas and the developed zones around them (arts. 32 and 35). Outside those areas, Ley 8/1975 requires military authorisation for a non-EU national to buy or build (art. 18), and notaries and land registrars ask for it before the deed is executed (art. 20). Ask the notary about timescales before you set the signing date.
When is it better not to buy land in Mallorca to build on?
When any of these warning signs has still not been cleared up by the day you are due to sign:
- The planning certificate says the plot cannot be built on, or it is urban but not a building plot.
- It is rural and does not meet the minimum area or the subdivision date rules.
- The house you want does not fit within the permitted floor area, or your plan depends on letting it to tourists.
If everything is in order, your project can begin. You will find the steps in our guide to building a house in Mallorca; what to ask whoever is going to build it, in how to choose a builder in Mallorca; and what the build includes, in new-build homes in Mallorca.
Buying land in Mallorca to build on is a decision best taken in this order: the paperwork first, then the technical assessment and, finally, the price. If you already have a plot in mind, tell us where it is and we’ll explain what we would check first.
Frequently asked questions
What documents should you ask for before buying land in Mallorca to build on?
At least three. The town council’s planning certificate, which in the Balearic Islands is called the certificado de aprovechamiento urbanístico, states whether the plot can be built on and is valid for six months (Ley 12/2017 de urbanismo de las Illes Balears, art. 64.2). The Land Registry extract (nota simple) shows the owner and any charges, and the Cadastre (Catastro) gives the reference value. On rural land you also need a Land Registry certificate of the plot’s history, which proves the date it was subdivided.
How many square metres do you need to build a house on rural land in Mallorca?
At least 14,000 m² on general rural land, transition areas and areas of agricultural interest, and 50,000 m² on forest land and in rural areas of landscape interest, under rule 20 of Mallorca’s Island Territorial Plan (Plan Territorial Insular de Mallorca, 2023 consolidated text). Only one house is allowed per plot, and the municipality’s general plan may require a larger area. In natural areas of special interest (ANEI), houses are prohibited.
Can you build a house on a rural plot in Mallorca that was subdivided after 1999?
As a general rule, no. Mallorca’s Island Territorial Plan (Plan Territorial Insular de Mallorca, rule 20.4, 2023 consolidated text) prohibits houses on rural plots subdivided since 13 October 1999. The only exception is the first division made by gift or inheritance from parents to children, with a maximum of one plot per child and only once. To check the date, ask the Land Registry (Registro de la Propiedad) for a certificate of the plot’s complete history (certificación del historial continuado).
What taxes do you pay when buying land in Mallorca?
If the seller is a private individual, you pay property transfer tax (impuesto de transmisiones patrimoniales, ITP) on a banded scale from 8% to 13%, under the Balearic Islands’ Decreto Legislativo 1/2014. If a company sells a building plot or buildable land, you pay 21% VAT (IVA) plus stamp duty (actos jurídicos documentados, AJD) at 1.5%, or 2% when the value reaches €1 million. The municipal capital gains tax (plusvalía municipal) is paid by the seller and only applies to urban land: in Palma, the rate is 18% in 2026.
Can a British or American citizen buy a rural finca in Mallorca?
Yes, but they need prior military authorisation if the finca lies outside urban areas. The whole island is a zone of restricted access to property ownership by foreigners (Real Decreto 689/1978, art. 32), and Ley 8/1975 requires that authorisation for anyone who is not a national of a European Union member state to buy or build. Notaries and land registrars ask for it before the deed is executed and registered. A German or French buyer doesn’t need it.
Can a new house built on rural land in Mallorca be used as a holiday let?
As a general rule, no. On protected rural land it is prohibited to start letting homes to tourists (Ley 8/2012 del turismo de las Illes Balears, art. 50.18). On common rural land, the 2020 Mallorca Tourist Areas Plan (Plan de Intervención en Ámbitos Turísticos de Mallorca) only allows it in homes that already existed when the plan was initially approved (art. 38.5.a). And in Mallorca the acquisition of tourist bed places (plazas turísticas) for homes remains suspended (Ley 3/2022, first additional provision).
